Dr .M.Veerappa Moily, Minister of Law and Justice informed the Lok Sabha in a written reply that the appointment of Judges of the Supreme Court and High Courts is made under Articles 124 and 217 of the Constitution of India respectively, which do not provide for reservation for any caste or class of persons.
The Minister further informed the House that in exercise of powers conferred under proviso to Article 309 read with Article 233 and 234 of the Constitution, the State Governments frame rules in consultation with the High Court for recruitment of persons to Subordinate judiciary. Therefore, the service conditions, including appointment, promotion, reservations, etc. of judicial officers of the District/Subordinate Courts are concern of the respective State Governments, Shri Moily said
