Anomaly in Promotees Pay Fixation after 01-01-2006
The Staff Side National Council Anomaly Committee has represented the revision of option issue in the Anomaly committee meeting and have requested that the first option exercised may not be treated as final keeping in view the new system of pay band and grade pays and that employees may be allowed to revise their option if the option is more beneficial to them..
Accordingly The Ministry of Finance(Department of Expenditure) issued an OFFICE MEMORANDUM No.F.No.7/14/2010-E.III (A) dated 5th July 2010 regarding Revision of Option. According to this OM , On further consideration and in exercise of the powers available under Central Civil Services (Revised Pay) Rules, 2008, it has been decided that in relaxation of stipulation under Rule 6 (4) of these Rules employees may be permitted to revise their initial option upto 31.12.2010 if the option is more beneficial to them. The revised option shall be intimated to the Head of his Office by the Government servant in accordance with the provision of Rule 6 (2) of the Revised Pay Rules, 2008.
Actually this revision of option is not that much beneficial to the promotees who got promotion after 01-01-2006 are concerned.It is an option between loss and big loss. The pay structure designed for 6 CPC is not convincing one to the promotees those who got promotions particularly after 01-01-2006. Because they will get merely 3% of the pay in the pay band +grade pay in addition to the meager grade pay difference as a promotion benefit. But the pay of direct recruits and new entrants is fixed at a higher stage when compared to the existing employees who were promoted in the same grade. To get this promotional benefit at par with the pay of direct recruits to the same post/grade, the government servants those who got promotions after 01-01-2006, had to exercise their option for revised pay on their promotion date despite loosing the 6cpc benefits from 01-01-2006.Revising the option between this and that will not rectify their financial loss. To avoid this anomalous situation, the minimum pay in the pay band has to be prescribed for each and every Grade, like Grade Pay fixed for every Grade. This is the only way to address this problem properly.

I get promoted from grade pay2800 to 4200 wef 1 apr 2015 . Again wef 25 may 2015 i get promoted g pay 4200 to 4800 . Please confirm how my pay will be fixed wef 1 jul 2015. It will be appreciated if anybody clarify please.
Sir,
I was apointed in AFHQ in the year 1993 and was transferred to EPFO in the year 1994. I was given pay protection. Subsequently,I was promoted as UDC in the year 1997 on the basis of departmental examination. Thereafter, w.e.f 01.04.2004, my pay was upgraded to 4500 and immediately was promoted to Sr. SSA in the pay scale Rs.5000/- In EPFO, there was a policy of Time Bound Promotion after completion of 17 years of service. One of my juniors, was given TBP and was placed in the scale of pay 5500 pre-revised, after considering her past service in other government department which she had rendered at Delhi. Later, TBPwas abolished and the post of TBP, Assistant and Sr.SSA were merged together w.e.f 01.04.2004. On 08.08.2010, a circular was issued by the H.O which read as follows:-
“On the basis of representations received from several Regions, and from All India EPF Staff Federation for removal of pay anomaly arisen due to grant of pay scale of Rs.5500-9000 to Sr. Social Security Assistant (TBP) who were promoted under Time Bound Promotion Scheme on completion of 17 years’ of clerical service and in the pay of Assistant [re-designated as Sr. Social Security Assistant)] being senior to Sr. Social Security Assistant(TBP) but continued in the pay scale of 5000-8000 (pre-revised).
2. The matter has been examined in consultation with Finance Wing of Head office and keeping in view the instructions of DOP & T, the Competent Authority is pleased to approve the stepping up of pay of seniors (Sr. Social Security Assistant) to bring it at par with their juniors [Sr. Social Security Assistant (TBP) as on 31.03.2004]. Pay will be fixed under Rule FR 22(1)(a)(2) w.e.f. 01.04.2004 notionally and financial benefits are payable w.e.f. 01.09.2007 i.e. from the date from which Sr. Social Security Assistant(TBP) were given the monetary benefits under the up-graded scale of Rs. 5500-9000 (pre-revised).
3. All Regional P. F. Commissioner’s are therefore requested to allow stepping up in such cases where Assistants (now, Sr. Social Security Assistant) are drawing less pay than their juniors [Sr. Social Security Assistant (TBP] accordingly.
Now, our office is of the opinion that only the then Assistants who are senior to the said official (TBP) are eligible for stepping up on par with the TB Promotee though they were drawing higher pay in the lower scale of Rs.5000/- Please clarify whether, the Sr.SSAs also are eligible for stepping up of pay in the pre-revised scale of Rs.5500/- as there as no differentiation between TBP/Assistants/Sr.SSAs and we were all drawing same pay in the same scale while we were UDC.
Sir, I am Murali, working in Central Govt, autonomous organisation. My pay in the Month of May 2011, was 16190 +Grade Pay 4600= 20790 (in the pay band of 9300-34500)
During June 2011, I was appointed (through advt. and selection committee) in same organisation in the pay of 15600-39100 with Grade Pay of 5400/-. I opted that that my Pay is fixed in the month of July, because I will get increment in the month of July 2011 by protecting my pay. Can any body clarify what is my pay in the month of July 2011?

I working in national Institute of Homoeopathy, Kolkata under Dept of AYUSH, Govt of India. I was selected at pay scale of 6500-10500 pre revised on 24 August 2009.
Institution is giving salary to 9300-34800 with GP 4200/-, whereas as per Finance ministry order Dated 13 Nov 2009, employee on pre revised pay scale at 6500-10500 are authorised to draw GP 4600/- in place of 4200/- without any approval of this department. But our Institute is still in confusion and paying GP 4200/-. As I have joined after 1.1. 2006 my basic payment should be Rs 12540/- in place of 9300/- CCS (RP)pay rules 2008. It is also informed that i am EX Serviceman and pensioner also.
Therefore please clarify if my Basic pay should be Rs-12540/- in place of 9300/- alongwith GP 4600/- as i am in pay scale of 6500-10500 pre-revised as per finance Ministry order and CCS (RP) pay rules 2008. Hope for your kind reply, please.

I was promoted on 1st May 2006 from the rank of HAV BASIC PAY RS. 4200/- To the rank of Nb Sub Basic Pay Rs. 5770/- in 5th CPC. I exercised option to fix my pay from date of promotion and fwd it to PAO.ORS Corps of Signals Jabalpur on 19th Nov 2010.But PAO ORs jabalpur not take action on my option form.PAO jabalpur saying they have not authority to acept OPTION FORM. Is Office Memorandum F.NO.7/14/2010-E III Dated 5th july 2010 not a authority to fix pay of PBOR from date of promotion upto 31st Dec 2010 who elect to draw pay in pre-revised scale till date of promotion .
While other PAO ORS except corps of signals PAO ORS accepting and taking action on OPTION FORM.
Kindly guide me for next step.
sir, i am a male nurse in a railway hospital since July 2005 and was getting less pay than my junior appointed after Jan 2006 on march 2008 but i was stepped up since my junior`s date of appointment on March 2008 in the same hospital but of my another junior working in another railway hospital appointed in 2007 getting more pay than me. here what mistake done by me that i am getting less pay while i am serving more one and half years so this is a great anomaly and its only one solution that the minimum pay in the pay band has to be prescribed for each and every Grade, like Grade Pay fixed for every Grade. thanks.
TIME BOUND PROMOTION : CSBOs (UNDER GS BRANCH COMMON ROSTER,SIGNAL-4 (C) SIGNAL RECORDS JABALPUR)
Time bound promotion scheme 16/26 years
(1) CSBOs (Telephone Staff under General staff branch signal record Jabalpur, letter No. B/44572/Balraj/Sig 4(c) /192/cc/D(QS) dated 27 Feb 2004 as under: ACP scheme of 1999 in respect of CSBOs may be withdrawn and previous ACp provision be cancelled and time bound promotion scheme may be given.
(2) Time Bound Promotion scheme pay scale was asunder:
(a) CSBO Gde-II Rs.3200-85-4900
(b) CSBO Gde – I Rs.5000-150-8000 after promotion/ or First Time Bound Promotion completion of 16years of service
(c) CSBO Gde-I second Time Bound Promotion after Completion of 26 Years of Service in the scale of Rs.5500-175-9000 and same scale for after promotion of TELEPHONE SUPERVISOR NO PROMOTION BENEFIT IS GIVEN.
(3) In the Sixth Pay Commission’s for the Time Bound Promotion Who has completed 16 years in the scale of Rs.9300-34800 old scale Rs.5000-150-8000,Time Bound Scheme CSBOs.Ref the Records Signals, Jabalpur letter No. 3669/CA-6/T-3/T-BP/04 dated 29 Jan 2010 first Time Promotion to those who have completed 16 years of service by giving Grade Pay Rs. 4200/-.But not given next Higher Grade Pay BENEFIT to the who has completed 26 years of service as second Time Bound Promotion and also not given benefit to who has promoted as TELEPHONE SUPERVISOR AFTER 01 JAN 2006 IN THE 6CPC.
(4) Sir, Ref to letter No. B/44686/6th CPC/Sig 4 (c) dated 28 Oct 2009 Time Bound Promotion scheme of CSBOs.As per para 4 and 5 in you are written that Para-4, as per para 13 of Annexrue-1 of DOP&T OM No. 35034/3/2008-Esst-(D) dated 19 May 2009 (copy circulated vide our letter No. B/44686/6th CPC/Sig 4 (c) dated 4 Jun 2009)existing Time Bound Promotion scheme or any other kind of promotion scheme existing for a particular category of employee may be continue to be operational for the concerned category of employee. Para-5,In View of the above, the existing Time Bound Promotion scheme in respect of CSBOs will continue to the operational.
(5) SIR THREE UP-GRDATION MAY BE GIVEN FOR CSBO,S
(A)IT IS REQUESTED THAT SIR, AS GIVEN BENEFIT TO FIRST TIME PROMOTION, WHO HAS COMPLETED 16 YEARS OF SERVICE BY GIVING GRADE PAY RS. 4200/-

Hi, Delhi High Court inits judgement dated 11th or 12th Oct 2010 has clearly stated that there should be one pay for one work. Does not all the Assistants (Dirct recruits or Promottees) are doing same work ? How is it justified if Direct recruits and promotees get different pay even though they are doing same work just citing 6th pay Commission recommendations ? Did the 6th Pay Commission specifically directed that Direct Recruit Assistants are superior to promotees and hence should be rewarded with more pay ? I think Sh. Kapil Sibal, Hon’ble Minister of IT & Communications and also HRD Ministry and a champion of just causes has a convincing reply to the agony of all the promotee Assistants.
Hi! I have been promoted as office superintendent from Senior Tax Assistant in Income Tax Department on functional basis. Pre-revised scale (5CPC) for Office Supt. was 5500-175-9000 while for Sr. Tax Asstt. was 5000-150-8000. After the recommendation of 6CPC, both the scales has been merged into PB-2 (9300-38400) with Grade Pay of 4200/-. Now the question is that being the grade pay same in both the posts, whether it will be taken as promotion technically. In this case, promotion is purely on functional basis, there is no change of grade pay resulting into no change of basic pay (neither any change in grade pay nor any benefit of one increment as in course of normal promotion, as per 6cpc). So, I have no financial benefit in this promotion. I would like to know whether any rule is available to protect the financial loss. Please let me know in this regard.
I got promotion 1/7/2009 from SA/B (Grade pay 4200) to SA/C(Grade pay 4600)in DAE.My basic was 11010+4600 GP on 1/7/2009 while direct joining in SA/C having basic is 12450+4600 GP. Kindly tell that when will the problem of pay anomaly of junior direct recruited and senior promoted after 2006 employee having the same post but drawing different pay.This is totally injustice for the seniors drawing less pay to their juniors.I could not understand that why the Govt is not solving the matter.

I want to know what is the fare those who got ACP before 2006 in 5500-9000 and got grade Pay 4200 from 15-9-2006
because after 1-1-2006 to 30-8-2008 promottee and ACP holder got 18460 from 1-1-2006 but why not this order implemented to ACP Holder I think ACP is equal to promotion and MACP equal to next Grade pay.

The pay structure designed for 6 CPC is not convincing one to the promotees those who got promotions particularly after 01-01-2006. Because they will get merely 3% of the pay in the pay band +grade pay in addition to the meager grade pay difference as a promotion benefit. But the pay of direct recruits and new entrants is fixed at a higher stage when compared to the existing employees who were promoted in the same grade. To get this promotional benefit at par with the pay of direct recruits to the same post/grade, the government servants those who got promotions after 01-01-2006, had to exercise their option for revised pay on their promotion date despite loosing the 6cpc benefits from 01-01-2006.Revising the option between this and that will not rectify their financial loss. To avoid this anomalous situation, the minimum pay in the pay band has to be prescribed for each and every Grade, like Grade Pay fixed for every Grade. This is the only way to address this problem properly.

The commission also not pescribed the minimum pay for promoition between the same payband.The promotee’s are incurring a huge loss due to the anamoly arising out of the entry pay and 3% increment. So, after the anamoly committee meeting it was stated that enabling orders in this matter will be issued soon. but till now, all promotee’s are awaiting the issue of the order by their respective departments. So, the association of central govt. employees is requested to look into the matter urgently.

realy it is a huge dissapointment to the promotee employees that they are getting less perk than their juniors who are recruited after 01-01-2006.i want to know that why it is so? the VIth cpc
have completed its more than two years but why such huge anomolies have not been short out? it creates a jwelious and dissapointed environment at work between juniors and seniors. i want to know the steps which are in progress to solve such problems.
While fixing of pay of constables in A & N Police, the pay of senior Police personnel (appointed prior to 01.01.2006) gets fixed in some stage lower than the direct recruits (appointed on or after 01.01.2006). The pay of Police Constables has upgraded from 3050-4590 to 3200-4900 w.e.f. 01.01.2006 after implementation of 6th CPC. This matter already taken with A & N Administration several time with the request that the matter may clarify from DoP&T, New Delhi. However till date the Admn. has not refer the case either to DoP&T nor to GOI MOF. About 600 constable are getting less pay than the Junior till date. Hope so GOI MOF may issue similar order to all Govt Employee as issue in the case of Railway & Postal Department

I fully agree with the comments of Mr. Sanjay Kumar that One Rank One Basic Pay with regard to the promotee Assistants / PAs. Kindly solve this issue at the earliest.
in vth pay commission senior scale PRT’s and TGT’s basic scale was same ie.(5500-175-9000). in vith pay commission both also have same pay band and grade pay ie.(9300-34000)and (4600)respectively.but on the time of fixation fresh TGT earlier whose basic was 5500 have been fixed on 17140.and senior scale PRT whose basic was 6025 have been fixed on 15810.this is unjustice with all senior scale PRT.so, concerned higher authority are requested take fruitful action for the same.

The pay of the seniors who promoted before or after 1/1/2006 should not be less than newly recruited employes. I don’t understand why govt. delaying the matter to issue orders for minimum entry pay to the seniors. Even though there would be a huge loss to the seniors if entry pay to the level of juniors is considered. But, still what they are thinking not understood.
It is expected to issue orders soon if they have any regard and knowledge about these matters.
Regarding anomaly in fixation of pay between direct recruits and
promotees, has been discussed in second Anomaly committee meeting.In this meeting the Staff Side reiterated that while applying Rule 8 of the CCS
(RP) Rules, 2008, the pay of direct recruits and new entrants is fixed at a
higher stage when compared to the existing employees who were promoted in
the same grade. The Staff Side demanded that this anomaly should be
rectified by incorporating a provision that in case after 1.1.2006, if a
promotee’s pay is getting fixed at a stage lower than that of a direct recruit as
given in Section 2 of the First Schedule of the CCS (RP) Rules, then the pay
of the promotee should be fixed at the same stage as that of a direct recruit1
new entrant so that the existing employees’ pay is protected at par with the
pay given to a new entrant. The Staff Side referred to the orders issued by)
the Ministry of Railways for stepping up of the pay of a senior employee who
is after promoted after 1.1.2006 and if his I her pay is fixed at a stage less
than that of a junior employee who is recruited after 1.1.2006 and requested
that Department of Expenditure should issue similar order1 clarification in
respect of employees of other Ministries/Departments. The Official Side,
however, was of the opinion that such orders should be issued only by the
concerned Ministries/ Departments after seeking approval of the Department
of Expenditure. Representatives of the Department of Expenditure also
informed that the order issued by the Ministry of Railways is not applicable to
all the cases and also that the same is applicable only in certain cases subject
to fulfillment of certain conditions. Therefore, Representatives of the
Department of Expenditure were of the view that a general order in this regard
might create more confusion and hence it would be prudent to deal with the
issue on case to case basis. In response to the suggestion of the staff side to
re-examine the matter, representatives of the Department of Expenditure
stated that the matter has already been examined and in cases, where the
conditions of stepping up are met, there is no difficulty. However, in cases,
where certain conditions are not met, it may not be possible to accommodate
the demand of the staff side with the broad principles envisaged by the 6’h
CPC in this regard. The staff side than stated that as per the relevant
provisions of the Fundamental Rules, anybody who is promoted, his I her pay
cannot be fixed at a stage lower than the minimum of the pay scale in which
he lshe has been promoted. The staff side further stated that any person, who
is appointed afresh to a post, is normally appointed at the minimum of that pay
scale. Therefore, whatever pay has been prescribed for a direct recruitee, has
to be treated as the minimum of that particular post in the concerned pay
band. On this basis, the staff side stated that pay of a promotee should not be
fixed lower than that of a direct recruitee in a particular pay band. The
representatives of the Department of Expenditure stated that as a general
preposition, this is not in line with the scheme of things envisaged and
implemented as result of the recommendations of the 6th CPC. Therefore,
agreeing with the demand of the staff side would mean departing from the
general recommendations of the 6’h CPC and therefore additional information
is required before taking any decision on this matter. In this regard the staff
side contended that it is a question of relevant Fundamental Rules and not
regarding the recommendations of the 6th CPC. The Staff Side insisted that
provisions of the Fundamental Rules are statutory and therefore, they are
above the recommendations of the 6’h CPC and would prevail over them.
Representatives of the Department of Expenditure stated that as per Rule 15
of the CCS (RP) Rules, 2008, the provisions of CCS (RP) Rules 2008 shall
prevail in case there is any inconsistency between these rules and
Fundamental Rules and therefore, the contention of the Staff Side regarding
inconsistency with the Fundamental Rules and provisions regarding fixation of
pay on promotion is not correct. After a prolonged discussion on the matter, it
was decided that the Official Side will re-examine the matter.
I was promoted from PRT to TGT on -4-09-2006 at that time my fixed on Rs 5850/-from Rs 5625/-What will be my pay according to 6th CPC. Kindly send me my pay fixation copy.If my junior is drawing more than me who is appointed on 09-09-2006 then why is the difference of pay between the pay of both the employee of same post or same cadre.Can this anomaly be removed or not.If this can not be removed then what should I do and where should I go to justice? Kindly inform me.

additional qualification examination were heild passing mark is 60 out of 100 for both general & reserved categary . i have got 58 marks out of 100 i am reserved candidate but there is no rebate given saying that disqualified .I am in Department of atomic energy , your order as reservation in promotion for sc/st candidatees promoted on their own merit, is it applicable in DAE (departmrnt of Atomic Energy)or not. is there a provision to rebate for sc/st candidate in DAE .
One Rank One Basic Pay
Recently 1467 Posts of UDCs have been upgraded to the Post of Assistants in CSS Cadre. Even after promotion as Assistant there is a large difference in Salaries of the Direct Recruit Assistants and promotee Assistants.
The Basic Salary of Direct Rectuitee Assistants is Rs. 18460/- [i.e. Rs. ( Pay Band ) 13680 + 4600 ( Grade Pay) ] and that of promotee is One increment ( in old Scale) + 4600 which is far less than. Promotee Assistants are more efficient in of Govt. working as they are already in Govt. Service more than 10 years or above. This is a serious injustice with promottee Assistant Inspite of these qualities the salary structure have such a large gap. This anomaly may be sorted out immediately considering One Rank, one designation one Basic Pay.
Sixth Central Pay Commission is not a bonanza to the lower level employees in any way as had been advocated by the media instead it is a classic example for discrimination. It has not addressed many issues pertaining to lower level employees seriously. In fact many fresh anomalies at lower level have been created instead of rectifying the existing ones. The difference is extremely high between Pay Band-3 and Pay Band-4. There should have been an intermediate Pay Band at the range of 28000-60000 which has deliberately been avoided. At lower level the difference between two pay bands is only nominal. There are a number of Grade Pays a at lower level with a difference of mere 100 rupees.
Min of pay Band-1 – 5200 Grade Pay- 1800,1900,2400,2800
Min of Pay Band-2 – 9300(diff- 4100) Grade Pay- 4200, 4600,4800, 5400
Min of Pay Band-3 – 15600(diff- 6300) Grade Pay- 5400,6600,7600
Min of Pay Band-4 – 37400(diff: 21800) Grad Pay – 8700, 10000, 12000
Pay Band- 2 has been created after merging the pre-revised scales of 5000-8000, 5500-9000 and 6500-10500- and Pay Band-3 has been created after merging the pre-revised scales of 8000-13500 and 9000-13500. It is a visible anomaly that for arriving the minimum of the Pay Band-2 only the minimum of the lowest pre-revised scales merged (5000) has been taken (5000 x 1.74-later changed to 1.86) where as for arriving minimum of Pay Band-3 minimum of the highest pre-revised scales merged (9000 x 1.74) has been taken. Now the pre-revised scale of 6500-10500 has been taken out and merged with pre-revised scale of 7450-11500 and given the grade pay of 4600/-. However, minimum pay as fixed as per the existing fixation formula of employees in position as on 1.1.2006 will be less than that of entry pay specified for direct recruits of grade pay of 4600/-. From all these things it appears that the lower level employee never gets any benefits even though their pre-revised scales have been upgraded.
Pay commission has not derived a separate fixation formula where merging of two or more scales has been taken place. Pay fixation in the revised scale is allowed to be done by pay drawn in the existing scale multiplied by 1.86 in all cases. In many cases the pay specified for corresponding grade pay for direct recruits is much higher than that of the pay fixed as per the fixation formula of existing employees. What the surprise is that such anomalies will not occur in the case of Pay Band-4 as the minimum of the Pay Band is much higher than that of multiplication factor of pay drawn in the existing scale by 1.86.
In many cases the clarificatory orders regarding pay fixation issued by the Department of Expenditure are also misleading and confusing. Method of calculation is not clear. Some examples are given below.
(i) For arriving the basic pay (pay in the pay band after including benefit of bunching) of Rs.6060/- for the upgraded post in pre-revised pay scale of Rs.3050-75-3950-80-4590 to Rs.3200-85-4900(Grade Pay: Rs.2000/-) at illustration 4A annexed to CCS(RP) Rules 2008..
(ii) For arriving the pay (pay in the pay band) of Rs.12540/- for Grade Pay Rs 4600/- as in First Schedule, Part-A Section II (Entry pay in the revised pay structure for Direct Recruits on or after 1.1.2006.
A clear cut clarification regarding pay fixation consequent upon grant of revised pay structure of grade pay of Rs.4600/- in the pay band PB-2 to Assistants and PAs of CSS, AFHQ, Railway Board and MEA is yet to be given. Some clarifications issued in piece-meals is totally confusing. It is stated that for Assistants and PAs in position as on 1.1.2006 the pay is to be fixed according to the fitment table of the pre-revised scale of Rs.5500-9000 where as for Assistants and PAs promoted after 1.1.2006 it is stated that their pay is to be fixed according to the fitment table of the pre-revised scale of Rs.7450-11500. As the pay structure(pre-revised scale) for Grade Pay Rs 4600/- is Rs.7450-11500 the question of taking pre-revised scale of Rs.5500-9000 does not arise.
The up-gradation was done vide Min of Finance, Deptt of Expenditure OM No. 1/1/2008-IC dt 16 November 2009. Even after ten months pay fixation has not been done in many departments due to want of a clear cut clarification. Some departments have done the fixation after taking 7450 multiplied by 1.86 as the minimum which is not being accepted by some other departments. Had the Pay Commission derived a fixation formula for the merged scale, such situation would not have arisen.
It is therefore, requested that the matter may kindly be taken up with the authorities and get the anomalies rectified.

Actually, Official side is not considering this because officers in PB-IV are list concerned with this and actually this is a anomaly of PB-I and PB-II. It is the only solution otherwise such anomalies will remain till next pay commission.
All the staff side members are earnestly requested to apprise this solution with National Anomaly Committee.
I have come to know that all SOs and PSs are going to get grade pay of Rs.5400/- from 1.1.2006 onwards. Any information on this?
