Subject- Revision of pension of pre-2006 pensioners – delinking of revised pension from qualifying service of 33 years.
In continuation of this office OM.No. CPAO/IT&Tech/Revision (Pre-2006) /Pensioner delinking of revised pension from qualifying service of 33 years, it is intimated that a clarification has been sought from DP&PW as to whether the OM dated 06.04.2016 is applicable to those Government servants also who had drawn lumpsum payment on absorption in Central Public Undertakings/ Central Autonomous Bodies. As such, the revision of such absorbee pensioners may be put on hold until DP&PW issues the clarification/ separate orders on the issue. A note to this effect has been placed with the list of pensioners to be revised on the basis of DP&PW OM dated 06.04.2016 in the PAC & CCA login provided on CPAO’s website i.e. www.cpao.nic.in

Judgement of Ernakulam CAT ON 19TH JULY 2016 HAS DIRECTED CG ..DPPW FOR RESTORING FULL PENSION FOR PSU absorbee WHO HAS RECD 100% LUMPSUM
In pursuance of government policy of promoting mobility of personnel to PSUS many persons had moved from Ministries to PSUs.The commuted value received by them in most cases was less than a months salary had they continued in the ministries.Many PSUS became sick or non profitable and the service conditions became unattractive over these years.Thanks to the intervention of the court one third of the pension was restored.The authorities concerned may kindly extend the benefit of OM dated 6.4.16 to PSU absorbees without further delay
Sorry to say that despite settled laws to the effect that absorbees in PSUs who had drawn lump sum and are entitled to restoration of 1/3rd commuted pension , are to be treated at par with other Central Government employees so far as restoration of 1/3rd commuted pension is concerned. Failed to understand why GOI has not issued guidelines simultaneously in this regard. The services in public sector on absorption in public interest may not be overlooked like this. GOI should come forward at the earliest instead of waiting for representations and unnecessary litigation.
No orders have been issued by DOPT regarding revision of their pension till date of those personnel who had drawn lump sum and drawing only 1/3rd pension. The orders of others have been issued by DOPT on 6.4.2016. The personnel drawing 1/3rd are most sufferer hence immediate attention is requested.
