Subject :- References/Representations/Court Cases in various Ministries / Departments / Organisations for grant of MACPS benefits in the promotional hierarchy – reg.
In continuation of Department of Personnel Training’s earlier O.M. of even no. dated 20.01.2016 and dated 01.03.2016 on the above mentioned subject, the undersigned is directed to forward a copy of the decision dated 28.04.2016 of Hon’ble CAT, Calcutta Bench in OA No. 351/00195/2014 filed by Shri S.H.K. Murti & Others Vs. UOI &Ors whereby the demand of the applicant for MACP in promotional hierarchy has been dismissed, for necessary action and compliance. The Hon’ble Tribunal in the aforesaid decision dated 28.04.2016 has held that the MACP benefit would be given in the hierarchy of next higher Grade Pay and not in Grade Pay of promotional hierarchy which will be payable on actual promotion.

There have been innumerable judgements/orders in favour of granting MACP in accordance with the prescribed heirarchy but unfortunately DOP&T was not relenting to its miconceived and misadventured and misdirected decision as usual. ACP/MACP was devised with a reason to give relief to the Govt. servant for not getting promotion after putting in long years of service. it was more pathetic in isolated posts with no promotional avenues. But by and large the reason was to compensate for the Govt’s failure to ensure promotion in time or even after a lapse of considerable time. But the introduction of innovative and great idea of granting MACP in the next grade which does not even exist in the heirarchy was malafide and condemnable as it defeated the very purpose for which it was designed. If DOPT complies with the order it would be a great relief to many particularly those who are in the lower rungs like MTS . It will ensure respectable pension to them .

HERE WE GET. MACP PROMOTION PB-3 TO CLASS C GROUP TO CLASS-1 GROUP ,EVEN FOR ADHOC ASCs,INSPECTORsDSC SCALE GIVEN..NO ASKER?NO TELLER RAJ…FLEXIBLE ORDERS? TAKE ADVANTAGE?? RAILWAY BOARD IN HANDS OF RPF???NO ACTION TAKEN ???
