MACP Joint Committee Meeting

The Minutes of joint committee on MACP is provided below.

The joint committee on MACP Anomalies met under the Chairmanship of Joint Secretary Establishment of  DOP&T on 25-5-2010. The staff side members of joint committee Sri. Umraomal  Purohit;  Sri.Juman Singh; Sri. S.K.Vyas and Sri.C.Sreekumar attended the meeting.

Though there are more than 30 items of anomalies submitted by the Staff Side to the consideration of the Joint Committee set up by the National Anomaly Committee to go into the MACP related anomalies, only around 8 items could be discussed in the first meeting held on 25.05.2010.The Secretary General of Confederation of Central Government Employees Sri.K.K.N.Kutty revealed in his circular-placed in the confederation blog -about the issues discussed in the meeting .

The following issues were discussed .

1. Item No:1:Provide Grade Pay of the next promotional post under MACP.Staff Side pressed for placement in the Grade Pay of the Promotional Post instead of next higher Grade Pay in the hierarchy of revised Pay Band and Grade Pay. It was insisted because the career progression only means the promotion in the hierarchy and not to a Grade Pay which is not present in the hierarchy of the respective department.

The Staff Side also gave an alternative that first two MACPs after 10 and 20 years should be to the next promotional post as per the hierarchy of respective department as under the erstwhile ACP scheme and thereafter the third MACP in the next Grade Pay of the Revised Pay Band and Grade Pay.

2. Item No:2:Date of Effect.

It was demanded that MACP scheme may be introduced with effect from 1.1.2006. A scheme which has been recommended by the 6th CPC will be not available to those employees who have opted for revised pay scales w.e.f. 1.1.2006 but had retired or died before 1.9.2008, which is very anomalous.

3. Item No:3:Option for earlier ACP Scheme.

Staff Side pointed out that the benefit which employees were getting through two ACPs after 12 and 24 years of service is much higher than the benefit that they will get under MACP after three financial upgradations. It was therefore urged that the service conditions which were available to the existing employees cannot be adversely revised and if that happens then an option to retain the old scheme is inherent. And if the present MACP is not converted to hierarchical pattern, then at least an option may be given to retain the erstwhile scheme of ACP.

4. Item No:7:Grant of financial upgradation between 1.1.2006 and 31.8.2008.

In Para 9 of the DOPT OM dated 19.5.2009, it had been provided that earlier ACP scheme will continue to operate for the period from 1.1.2006 to 31.8.2008. However, this is not being allowed to officials who have opted for revised Pay Band and Grade Pay with effect from 1.1.2006. In some offices, it is being insisted that financial upgradation under the earlier ACP would be granted only in the pre-revised pay scales and they will have to opt for the revised pay scales only from the date they are granted the financial upgradation under earlier ACP. It was demanded that earlier ACP benefit may be given also to those officials who have come over to the Revised Pay Band and Grade Pay with effect from 1.1.2006.

5. Item No:8:Anomaly on introduction of MACP Scheme.

By an illustration in respect of Junior Engineer of CPWD, it has been pointed out that under earlier ACP they will go up to the revised Pay Band 3 with Grade Pay of 6600/- on completion of 24 years of service, whereas under the MACP Scheme, even after 30 years of service and getting third MACP they will get the Grade Pay of 5400/- only in PB-2. This is obviously less advantageous and therefore the demand for option to retain the old ACP scheme has been insisted.

The Official Side indicated that they will consider all these demands and in the next meeting they will indicate how far they can go.

6. Item No:4: Applicability of MACP  Scheme to Group D employees who have been placed in the Grade Pay of 1800/-.

The DOPT had already stated that all promotions and upgradations granted under ACP Scheme of 1999 in the post of four pay scales S-1, S-2, S-3 and S-4 shall be ignored for the purpose of MACP. In other words all the three MACP will be available to all the Group D employees who have since been placed in the grade pay of 1800/-. If an employee has completed 10 years of service he should be granted the GP of 1900/-; if completed 20 years of service he should be granted the GP of 2000/-; and if he has completed 30 years of service he should be placed in the GP of 2400/-. In some departments these MACP has not been granted to the Group D employees. The staff side therefore insisted an enabling clarificatory instructions may be issued. The Official Side agreed to issue such clarificatory instructions.

7. Item No:5: Counting 50% of service rendered by Temporary Status CLs for reckoning 10,20, and 30 years of service under MACP scheme.

It was pointed out that the Railways have already issued orders for counting 50% of service rendered by Temporary Status Casual labourers for reckoning 12 and 24 years of service under the old ACP scheme. It was also pointed out that Courts have also ordered that total service rendered as TS CLs may be counted for the purpose of ACP. The Official Side were of the opinion that 50% of service rendered by TS CLs has been counted only for the purpose of pension. The Staff Side pointed out that the TS CLs have been granted all the facilities admissible to a Temporary Employee in respect of leave, increment, pay scale etc and therefore this may be deemed as a regular service for the purpose of MACP also as has been done by the Railways. The Official Side wanted the order of the Railway Department regarding ACP and the Orders of the Courts for their examination.

8. Item No:6: Supervised staff placed in higher Grade Pay than that of the supervisor.

The Staff Side suggested that this item may be transferred to National Anomaly Committee item and discussed there. This has been agreed to.

There are 23 more items which have been suggested by the Staff Side leaders of Railways. It was pointed out that leaders of other departments may also suggest many other anomalies related to MACP. The Staff Side stated that as and when these additional items are received they may be included in the Agenda for discussion in the subsequent meetings. The Official Side agreed to.

    I was appointed in the pre-rev scale of 4500-7000 on 21.06.1999. in the same post/pay scale 4500-7000 a employee junior to me appointed on 30.06.1999. On 11.11.2003 I was got appointed/selected as a translator in the scale of 5000-8000 and my pay fixed to Rs.5150.Later on after completing the 10 years service on Jul 2009 the said employees got MACP in the grade pay Rs.4200/-.
    Now after the MACP his pay fixed on 01.7.2009 as Rs.18740 wheras my basic remains only 18190/-. Kindly clarify whether I am eligible for stepping or not.

  2. had appointed as MBoy in 18.06.1980 and got promotion from MBoy to Order in 24-12-1984. I had appeared Departmental LDC examination in 1985 and appointed as LDC 14-Julu 1989. Then I had again appeared for Stenographer appontment examination and appointed/promoted in Stenographer in 27-07-1993. After that I had promoted as PA-II in 29-09-1998 and PA-I in 2004 but as per the 6th CPC govt. have merged PA-II and PA-I and now PA-I and PA-II is treated as PA only. I wish to know that I am not geeting MACP benefit after merge of PA-II and PA-I after completion of 13 years in the same grade after merge of PA-I and PA-II. Kindly help how to get MACP

  4. why the gp of TA in CBDT is 2400 only and gp of Divisional Accountant is 4200. TA passed the computer test too but Divisional Accountant only on merit base.

  6. MACP is stupied scheme. The government should think for the welfare of the employees. what is the fun of introducint such scheme which is a loss when compared to the previous ACp. The 6th pay commission is meant for bada babus only. the low level category employees are stabbed. always in all fields the poor and low level staff are at loss.

  7. I am agree with the view of Shri Sri Krishna Chaitanya. The MACP scheme is useless for Steno Gr.III and UDC. The MACP should be given on next promotional post to make the MACP Scheme more beneficial than the earlier ACP Scheme. If there is loss to employees, what is the need of a scheme unnecessarily?

    The main sufferers are stenographers gr.iii who will get next GP 2800 instead of 4200 under MACP which only grants next GP hierarchy. I hope the JC for MACP will reddress it.

  9. I have joined as Sepoy in Central Excise, Ahmedabad i have been giving table work or computer work.may i know. why the departmental promotions are so late for sepoys. i wona work as tax assistant. but who have passed LDC exam in 1990 yet not promoted.

  10. I JOINED THE CSCS AS LDC IN 1987 AND PROMOTED TO UDC IN 1996. MY PAY WAS FIXED UNDER GRADE PAY 2400. NOW I GOT MACP AND WAS GIVEN AN INCREMENT AND GRADE PAY 2800. MY PROMOTION IS DUE NOW FOR ASSISTANT BUT I AM BEING TOLD THAT I WILL BE GETTING ONLY THE BENEFIT OF GP I.E. RS.4600/-. NO FIXATION OF PAY WOULD BE DONE. WHAT A JOKE.

  11. I am working as a Section Officer in National Horticulture Board, an autonomous body under Ministry of Agriculture. I had been granted pay scale of Rs.8000-13500 w.e.f. 11.8.1999 under ACP. As per our staff rules this pay scale falls under Group’A’ category. While fixing pay as per recommendations of 6th Pay Commission w.e.f 1.1.2006, I have been granted Grade Pay Rs.5400/- in Pay Band-2 and not Pay Band-3. Please see if the Pay Band-2 granted is correct or not and if not please guide, how it could be corrected

    after implementation of macp, JE’s of CWC ( central Water Commission)who had completed 24 year service before 01.09.2008 are getting Rs 5400 Grade Pay whereas after 01.09.2008 are getting Rs. 4800.After completion of 30 years service they will get Rs. 6600 Grade Pay (macp III) and we will get Rs. 5400 grade Pay ( macpIII). In the same post Grade pay’s are different.What is the way to solve the such type of anomaly in grade pay in the same post of Junior Engineer of CWC?.Kindly inform

    You are requested to consider following points :-

    1. Why Higher Level (Class 1) Officers are given 5-6 promotions without passing further exams for promotion ? i.e. Under Secretary –>1. Deputy Secretary –>2. Director –>3. Joint Secretary –>4. Additional Secretary –>5. Secretary –>6. Cabinet Secretary; etc.

    2. Why Lower Level Officials (other than Class-1 Officers) are restricted to only 01 or 02 promotions without passing further exams for promotion ?

    3. What is the Government planning/doing for reducing Strikes/Agitation, corruption and Court Cases etc. at Lower Levels (other than Class 1 Officers)?

    4. What is the Government planning/doing to reduce Mess at lower levels (other than Class 1 Officers) and doing efforts for smooth sailing for promotions etc. as available at higher levels (Class-1 Officers)?

    5. Why generally LDC has to pass UDC exams and prove oneself to get maximum 03 promotions ? LDC-1. UDC (after Exam) -2. Assistant & -3. S.O. (Promotion)

    6. Why mostly Assistants have to pass S.O. exams and show skill to get max. 03 promotion ?Assistants – 1. S.O.(after Exam) 2.Under Secretary 3. Deputy Secretary (promotion)

    7. Why LDC has to pass UDC and S.O. exams and then entitled for max. 04 promotions ? LDC-1.UDC (Exam)-2, Assistant (promotion)-3. S.O.(Exam)-4. U.S (Promotion)

    8. Why exams at only lower levels for promotion, when most of them are Graduates except Peons ?

    9. Why not exams for promotion at higher level (Class 1) Officers, when most of the competence, skill, knowledge, responsibility etc. is required at higher levels for policy making, framing rules & regulations, FR & SR, new projects, Court Cases, foreign tours, planning etc. ?

    10. Who makes Promotion/Recruitment Rules, Pay Structure etc. for Lower Levels officials (other than Class-1 Officers) in Government of India ?

    11. Why not at least benefit of 4 Promotions be given to lower levels (other than Class 1 Officers), without passing any further competitive exams for promotion ?

    12. What is the Government of India planning/doing for conducting competitive exams even for promotion at higher levels (for promotion of Class 1 Officers) ?

    13. What is the Government of India planning/doing for providing equivalent pay/salary for the denied due leaves, when leaves are denied in the interests of the work of the Government, while higher level (Class 1 Officers) generally get not only, due leaves, but also, enjoy foreign Seminars/Tours/Trainings/Workshops etc. along with financial benefits including Foreign Allowance, TA / DA etc.?

    14. What is the Government of India planning/doing for fixing of salary from the date of issue of Promotion Order, instead of date of joining, when joining is delayed/deferred, in the interests of the work of the Government, as joining of duty of Lower Level Officers (other than Class 1 Officers) on promotion is delayed/deferred, thereby causing lot of financial losses to them, while Officers at higher levels may generally join duty immediately/same day of Promotion Orders?

    15. Who keeps the interests of Lower Level Officers (other than Class 1 Officers) all the time, while framing FR & SR, other rules etc. – Government / Higher Level Officers / Agitation / Strikes / Unions / Welfare Associations / Courts ?

    16. What is the Government of India doing for removing in-between Grade Pays between the two Posts for Lower Level Officers (Please see Table given below)

    17. How many Vigilance Cases are pending in Departments of Government of India against (i) Higher Level (Class-1 Officers) (ii) Lower Level Officials, (Please give separate figures)?

    18. What is the Government planning/doing to provide equal number of promotions to Lower Levels, as is given to Higher Levels (Class-1 Officers) ?

    19. What is the Government planning/doing to protect the interests of Lower Level Officers (other than Class-1 Officers), as and when the Rules for Promotion/Recruitments/Pay Scales etc. are amended/framed?

    20. Why the Government of India is not interested to give the benefit of Actual Grade Pay of next promotion to lower levels, even after their 10 years of Service ?

    21. How much the total amount of Salary paid including Foreign Allowance, TA, DA was given during the last four Financial years separately to (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) of Government of India year-wise ? (Please give figures separately for (i) and (ii)?

    22. Why not, Promotion Rules, Recruitment Rules (FR & SR) including modified ACP Rules, etc. may be made and considered in such a manner, which may provide smooth sailing not only at higher levels, but also at lower levels, thereby minimizing mess, agitation, strikes, corruptions, court cases, etc. at lower levels ?

    23. How many total court cases are pending of (i) Higher Level (Class-1 Officers) (ii) Lower Level (other than Class-1 Officers) in Departments of Government of India?

    24. What is the Government of India planning/doing for upholding the promotions of Class 1 Officers for more than 10 years, so as to bring all the Officials under the Modified Assured Career Progression (MACP) and reduce the overall burden of expenditure on Salaries etc. ?

    25. What is the Government of India planning/doing to insert Grade Pays in between two posts also for Higher Ranks (Class 1 Officers), as are applicable for Lower Officials (as can be seen from the table given below)?
