Points Discussed in the Third Meeting of National Anomaly Committee

The Secretary General of Confederation of Central Government Employees and One of the member of National Anomaly Committee Sri.K.K.N.Kutty has briefed about the out come of the recently held Meeting of National Anomaly committee,in his blog today.

According to him,

The third meeting of the National Anomaly Committee was  held on 15/02/2011. The following items were taken up for discussion.  No final decision on any item could be arrived at.  It was more or less an exercise to understand the points of view of both sides on these items. We shall in our next communication indicate the outcome of discussion on each item.

Item Nos. 11, 12&13, 14, 20, 28,29&30, 31,37, 38,39, 40, 41, 43, 44, 45, 46, 49, 50 and 51.

During the discussion the Staff brought to the notice of the official side that the issues pertaining to the employees of Andaman  and Nicobar islands, which were taken out of the agenda on the plea that the same would be discussed separately by a Committee to be set up by the Andaman Administration have not been settled.  The NGO Association of A & N Islands have brought to the notice of the staff side that the A & N Administration has not taken any steps to resolve the problems even though similar issues pertaining  to the employees of Pondicherry and Delhi were settled.  The Official side has promised to take up the issue with the concerned in the Home Ministry to ensure that the issues are addressed expeditiously.

The official side has in the Action Taken State has indicated their inability to concede the demand raised by the Staff Side on the following two issues.

(a)    Grant of increment in the case of employees whose increment falls between Feb and June. 2006.

(b)   Fixing the pay of the promotees on par with the Direct recruits.
Though these issues were not discussed, the Staff Side has said that a resolution to them are urgently needed .

The official side has requested the Staff Side to indicate the items on which further discussions are needed; further details are required; and alternative suggestions could be made  within 10 days so that the next and final meeting of the Committee could be convened before 31st March, 2011.  It was also decided that the sub-committee of the MACP related issued will meet once again and their report submitted to the NAC

    I am appointed in CISF on 10.09.1991 and granted ACP wef.10.09.2003 in the scale of Head Constable i.e. in lieu of promotion to the rank of Head Constable. On recommendation of 6th Central Pay Commission wef.01.01.2006, the pay fixed in the Pay Band Rs.7220/- and Grade Pay Rs.2400/-. Whereas the pay fixed of direct recruits who are appointed on or after 01.01.2006 in the rank of Head Constable is Pay Band Rs.7460/- and Grade Pay Rs.2400/-.
    Please guided me on anomally of pay. Whether any order have been issued in this regard.

    I am promotee officer in BSF, Now my Deptt has given benifit of MACP to my direct entry junior officers, I am getting low grade 6600 and now they are getting higher grade 7600 and one increment extra. But as per Govt rule that in such cases senior will be upgraded at par with junior. kindly clarify.

Employees whose increment date fell between 1 Feb to 30Jun in V th CPC time were punished with future effect without any crime and whose date of increment was 1 Dec were rewarded without doing anything.pay commission is suppose to give the financial benefit to all employees but few are rewarded and few are punised with future effect. This is against the natural justice. representation made through trade unions but still result is awaited.do the justice as early as possible being major anamoly in vi th cpc..

    I am a staff nurse (railway)appointed in 1999, got promoted as nursing sister on 27th Sept 2006.My junior staff nurse who was not promoted with me was given step up in par with juniors pay on march 2007 (till then no new entry as staff nurse occurred) and there after she was promoted as nursing sister in November 2009.From this date onwards my junior is getting more pay than me.Even after giving application no step up is given to me.

    Is it a matter of anomily?
    Is there any similar case?
    What shall I do to get Justice?

  5. Fifth pay commisson had granted the pay scale of 6500-10500 to the Income Tax Oficers w.e.f. 1.1.96. There was quite a movement for a higher pay scale for ITOs and ITI’s which bore fruit on 21.4.2004.It was implemented from 21.4.04 while those who were ITO’s on 1.1.96 but were promoted to the post of ACIT by 21.4.2004 were grossly deprived of the benefits. I heard it was stillunder discussions but nothing fresh has come afore on the issue in question. Is there anything on this subject?

I am a railway employee, appointed as staff nurse in 1999 and got promotted as nursing sister in september 2006.Between 1-1-2006 and my promotion date no new staff nurse joined,so I didn’t get step up of pay. In march 2007, new staff nurse joined and my juniors who was not promotted with me got the step up of pay in par with the minimum entry pay.My pay was even lower than their pay .So I applied for step up of pay and was rejected citing the reason that we were holding different posts.Now my juniors also got promotted as nursing sister(the post that I hold presently), and they are drawing more pay than me.Still no step up is given to me. If it is a matter of anomily please take up the isue.Otherwise somebody help me,what shall I do?

    anomaly regarding (Item No-28)grant of grade pay to Asstt Accounts officer/Asstt Audit officer needs to be finalized as early as possible as the frustration is growing among them very sharply. Their subordinate staff under group ‘c’ are drawing grade pay of Rs 5400/- (granted under MACP) moreover their entitlement is also excess then their supervising staff. This is a big joke. Is this a definition of grade pay that grade/status of supervisory staff is below his subordinate staff

  8. Kindly change the grade pay of LDCs from 1900 to 2400 at least because it is too less for the poor LDCs.

  9. Two PAs were promoted vide DOPT orders dated November 2006. A, (the junior ) has joined about one month before B ( the senior) . B has left behind because of non relieving from the previous office. Both were granted 1st ACP after 12 years and were getting the same scale before and after promotion as ad-hoc PA. Now the Junior has superseded the Senior. The Senior has lost one increment due to non joining before 1.1.2007. Although he is continuously in service and drawing the same pay which he got after promotion. If he was not promoted he will definitely get the increment for the year 2007. This so called promotion is a clear-cut demotion after more than 20 years. Please also see the difference between A and B :

    There will be so many PAs suffering from this so called promotion. I have two suggestions to remove this anomaly”

    1. Fix the pay @7450/- in place of 6500/- from August 2006. or
    2. Give increment to every one who joined on promotion between January to June. ( difference between two increments should not be more than 12 months).

    Due to this minor thing a junior should not be superseded the senior.

  11. A very good article have been written on the three pay scale of Rs.5000-8000,5500-9000 and 6500-10500. The pre-revised pay scale are merged into a single pay scale of 6500-10500,the grade pay is upgraded to Rs.4600/- vide Govt of India Min of Fin OM dated 13 Nov 2009 but the pre-revised pay scale of 5000-8000 and 5500-9000 are ignored and they remained with the Grade pay of Rs.4200/-. Most of sufferers are Admin Supdt and Stores Supdt. in DRDO’s Lab/Estt. Hopse the Govt will consider the demand for getting Grade pay Rs.4800 to all pre-revised pay scale of 6500-10500 (Gazetted Group B Posts) and grade pay of Rs. 4600 to all pre-revised pay scale of 5000-8000 and 5500-9000 ( Group B non Gazetted post) this will help most of subordinate offices to maintain the hierarchy and function well.I will bring to your kind notice sir,most of Admin Supdt and Stores Supdts in DRDO Lab/Estt have been retired during the Aug 2006 to Oct 2006 with grade pay of Rs.4200.

    It was also held by Honorable Supreme Court in Nehru Yuva Kendra Sangthan V Rajesh Mohan Sukhla and others (reported in SCC (L&S) 286) that EQUAL PAY FOR EQUAL WORK WILL BE APPLICABLE irrespective of sources of recruitment.
    When we are going hear the news that order of upgradation of grade pay of Rs 4200 of pre-revised scale of Rs.5500-175-9000 made to Rs. 4600 is issued wef 01-01-2006 for Admin Supdt and Stored Supdt in DRDO Lab/Estt and others department of lower formation.
    It is therefore,requested that the matter may kindly be taken up with the authorities and get the anomalies rectified at your earliest.Regards and thanks.

    Dear Sir
    Iam working in Western Electricity Company of Orissa Ltd. as Junior Accountant from 27th July-20004.My post had been regularised after 2 years of training on dt 27th July 2006.Our wage board has given its report after 6th pay commission introduced by Govt. of Orissa.But to our irony of fate we did not get the Entry Level Pay which has been fixed in Central Pay Structure.Our old scale was Rs.4470 on dt 27th July 2006.But when our wage bord revised or pay, it did not consider the Entry Level Pay for the new recruits and our pay has been fixed in the minimum of the pay band as in Rs. 5200.00.For which what we were getting in the old pay we got less amount after pay revision.We are suffering a lot for this decision.
    So I request the Central Anomaly Committee should consider this matter and revise the entry level pay for the new entrants joined after dt 01-01-2006.In my point of view it should revise the pay for all by multiplying the old scale in to 1.86 irrespective of date of joining to rationalise the pay structure and for intrepretation of the same for all state govts.

    Sir,

    Pay of departmental candidates passing the departmental exam is fixed on lower side than a person getting appointed through direct recruitment on same post. This is a very big injustice being done by the Government. For same post and same work how different pay can be fixed. Anamolly committee should accept the general principle of equality and should accept same starting pay for a post appointed either through departmental exam or through direct recruitment.

    Please guide me on this matter. Whether any orders have been issued in this regard.

    Can anybody inform whether there is any possibility of enhancement of Grade Pay in respect of Private Secretary/Section Officer of Central University (autonomous body) to Rs. 4800? General perception tells that the GP should be 4800, however, it has been fixed at 4600 whereas keeping in parity to earlier position that should have been enhanced. It is interesting to note that in some other organisation(s) such as CSIR, ICAR (which are also central autonomous bodies) the respective grade pay have been increased to 4800 after 4 years to 5400. But we in the central universities are in dark about this.

Now there should not be discussions but a legal course should be initiated by our Associations who are discussing on employee’s behalf.

    I am working the University since 2005 and got promotion in the grade of 4000-100-6000 after 6cpc. The fixation has been made in 5200-20200 by x 1.86 factor. Though as per 6cpc report a direct recruity under 4000-100-6000 grade his initial pay as per 6cpc is 7520/-. Sir this unjustified as there is no direct entry in my University in grade of 4000-100-6000. Hence this provision of 6cpc should be removed or fixation of promotees and direct entry should be equal.

    Sir, I was appointed in NVS on 1.10.2003 and my Pay is 12840 + 4800 (Grade Pay)on 1.1.2006 whereas Entery Pay is 13350+4800 (GP)on 1.1.2006. juniors who appointed on 1.1.2006 or later got higher Pay after fixation in the revised scale than me.

    Hence, it is requested to publish any orders issued by Anomaly Committee to step up my pay at par with juniors and pay disparity may also sorted out and instructions may also be issued for payment of arrears please. For this act of kindness I shall ever grateful to you Sir.

    I am serving as Store Supervisor in Border Roads Organisation. I appointed this post on the basic qualification Diploma in engineering. My pay scale is 5200-20200 with grade pay Rs. 2400/-.
    As per 6th CPC recommendation all posts carrying minimum qualification with diploma in engineering should be placed in grade pay Rs. 4200/-. But till date this grade pay not extended.
    Request advise what should I do now?

IN 6TH PAY COMMISION THEIR ARE SO MANY ANOMALIES WHICH SHOLD BE REMOVED. GP SHOULD BE PROPOTIONATELY.INCREMENT SHOULD BE 5%.IN MACP WHETHER IT IS A MURDER OF PREVIOUS ACP?. IN MACP JE WILL GET GP FROM 4200 TO 4600 TO 4800 TO 5400 WHILE OTHER (JOIN BEFORE 31-8-1984) WILL GET 4200TO 4600 TO 6600 TO 7600.HOWEVER THEY PERFORM THE SAME DUTIES WHICH IS AGAINST THE GOVT OWN POLICY.SAME WORK&POST BUT SALARY DIFFERENCE ABOUT Rs 6000/-WHICH WILL BE UP TO 15000/-AND TOTAL LOSS OF ABOUT Rs 30 LAKHS. ENGINEER SHOULD GET 25%AS TECHNICAL ALLOWANCE. THE PREREVISED PAY SCALE OF7450 SHOULD GET POINT TO POINT INCREMENTS. THE GP OF 7450 SHOULD BE IN THE SAME RATIO OF 5000 SCALE IE APPROXIMATE BE 6000/ SIR YOU ARE REQUESTED TO LOOK THE MATTER SERIOUSLY TO PREVENT JEALOUS & HATRED AMONGST EMPLOYEES .AND ALSO I HAD NOT GOT THE PROMOTION SINCE JOINING (20-10-84)THOUGH I AM ELIGIBLE AND FIT FOR PROMOTION SINCE 13-09-88.It is suggested that in MACP Of 10-20-30 should be amended to 12-24-30 with same PB&GP as promotional for 12-24 and for 3rd macp after 30 may be next GP of hierarchy for all, does not violate the rule same post same work same salary as against 10-20-30

  24. Dear Sir,
    I joined as on 16-09-1983. Till now I am LDC. I got 2 acps as per old acp scheme i.e before the date of implementation of 6th cpc & macp. The two acps were granted according to the heirarchy of the posts of our department i.e LDC/UDC/Head Clerk. Financial Upgradations are granted instead of pormotions due to non availability of vacant posts in the departments heirarchy. I was drawing the scale of pay of Rs.4000-100-6000(1st ACP Year 1999) and Rs.5000-150-8000 (2nd acp) w.e.f. 16.09.2007. According to the 6th CPC my pay was fixed by the department in the Grade pay of Rs.2400 and then 4200. Audit objection is that I should have been granted 2800 GP as per the pay structure of the 6th cpc. Difference of GP of Rs.1400/- Pay Anomaly raised now may please be settled by the Pay Anomaly Committee. I would like to ask when I will get GP of Rs.4200/- I may get promotion only in the year 2015 or 16 as per vacancy exist on retirement of the UDCs/Head Clerk. Then when i will get 4600 GP some of the UDCs in our department those who have rendered more than 30 years of service as on 1.9.2008 have been granted 3rd MACP of GP 4600.

Sir, in Army HQ exchange the person who is having a service of 16yrs completed is getting a grade pay of 4200/- as well as who is serving in the same office since last 32 years is also getting same grade pay isn’t humiliating that only one promotion has been granted to each & every operator from joining duty till retirement. kindly do some thing

Representations have been sent to the National Anomaly Committee as well as central government employee’s welfare co-ordination committee to consider granting separate higher Grade Pay to the Office Superintendents of subordinate offices as distinct from Assistants of subordinate offices. This was demanded as the Office Superintendent is feeder post for promotion to that of Assistants. Since Assistants of Secretariat services has been granted with Grade Pay of Rs.4600/- it is injustice that if the Office Superintendents, who are supervisors of subordinate offices, left behind and are downgraded to that of down posts of Assistants in subordinate offices. It is not understand how government is going to designate the merged post? is it as Office Superintendents ? or Assistants ? If Office Superintendents then all Assistants become Office superintendents and supervisors? If it is Assistants then all Office Superintendents are downgraded and become clerks and no supervisors are there in subordinate offices?. No where it is mentioned in the anomaly committee discussions, appeared in the various websites, such an issue is taken up by the coordination committee or by the National Anomaly Committee themselves. I request the concerned in the co-ordination committee (staff side representatives) to consider this request sympathetically as if they are facing the problem and present to the anomaly committee favourably.

  27. I WAS APPOINTED AS DURWAN IN 1982 & PROMOTED TO LDC BY DEPARTMENTAL EXAMINATION IN 10% QUOTA IN 1988.

    ONE OF MY COLLEAGUE WHO WAS APPEARED WITH ME FOR DEPARTMENTAL EXAMINATION IN 10% QUOTA WAS FAILED.

    AND NOW HE IS PROMOTED AS LDC AFTER 4 MONTH WITH DIRECT RECRUITMENT.

    HE IS MATRICULATE AND I AM GRADUATE.

    HE IS GETTING MORE SALARY THAN ME BECAUSE OF HE GOT ACP.

    HE IS JUNIOR THAN ME

    NEWLY APPOINTED LDC IN 1988 IS ALSO JUNIOR THAN ME AND THEY GOT ACP.

    KINDLY CONSIDER MY CASE IN ANOMALY COMMITTEE AND GIVE ME JUSTICE

My Pay on June 2010 is 7090 (pay)+2000 (GP) and juniors got higher Pay after fixation in the revised scale than me.

    Hence, it is requested to publish any orders issued by Anomaly Committee to step up my pay at par with juniors and pay disparity may also sorted out and instructions may also be issued for payment of arrears please. For this act of kindness I shall ever grateful to you Sir.

  30. what about the time bound promotion scheme for Telephone Staff under general staff branch under sigs-4, signal record jabalpur.
    CSBO Gde-II Rs 3200-85 4900
    CSBO Gde-I Rs.5000-150-8000 or completion of 16 years of service first time bound promotion
    CSBO Gde-I Second time bound promotion after completion of 26 years of service Rs. 5500-175-9000 and same scale for who gets promotion as Telephone Supervisor No seprate benefit is given.

    In sixth pay commission letter No.3669/CA-6/T-BP/04 dated 29 Jan 2010 published who has complted service 16 years given first time bound promotion by granting the Grade pay Rs. 4200/-

    But no Grade pay is increased who has completed 26 years of service and who has promoted as Telephone Supervisor.

    According to the office memorandum no. 35034/3/2008-Estt.(D) Govt of India Ministry if personal, Public Grievances and Pensions (Department of
    personal and raining) dated 10 May 2009, old ACP scheme 12/24 is upgraded to 10/20 and third upgradation after completion of 30 years of service.

    It is requested that sir, Time Bound promotion Scheme of CSBOs/Telephone Opearators and 16/26 may be upgraded with separate Grade pay as Rs. 4200/- Rs. 46/- and third upgradation as Grade pay Rs. 4800/-

    It is also requested the who has promoted as telephone Supervisor may be given seprate Grade Rs. 5400/- an early action may be taken in the next Anomaly Committee.

  31. Fixing the pay of the promotees on par with the Direct recruits is an important and necessary issue which NAC should consider in the best interst of all employees.

    Sir, A person got promotion in December, 2005 and get the benifit of Fixation, however a person get promotion after the date but before publishing the 6th CPC had loose the benifit. How far it is justified ? Suppose two officials selected in the DPC for promotion in the same year and one person got promotion in Dec. and another person in February. Both were drawing same salary in the scale of 5000-8000. The official got promotion in Dec., his salary fixed in the initial of Rs.6500/- whereas the official got promotion in Feb. got only one increment in the old scale. So, in the 2nd case the difference is huge. Atleast for one post the minimum initial payment in this case should be 6500 x 1.86 (as per calculation of 6th CPC).
