Sub: Reservation for Persons with Benchmark Disabilities Suggestions, if any, from all concerned including general public.
The undersigned is directed to enclose a copy of draft instructions bringing them in line with ‘THE RIGHTS OF PERSONS WITH DISABILITIES ACT, 2016’ with regard to reservation for Persons with Benchmark Disabilities in the posts/services under the Central Government
2.The issue of reservation in promotion for Person with Disabilities is sub-judice in various cases in the Hon’ble Supreme Court Including Civil Appeal NO.1567/2017 titled Siddaraju Vs State of Karnataka & Ors and Review Petition (C) No.36/2017 tagged with it.
3. It. is requested that the draft instructions may be examined and suggestions, if any, may be sent to this Department within 15 days of the issue of this Office Memorandum through e-mail only at [email protected] and [email protected].

DOPT HAS INTENTIONALLY NEGLECTED HON’BLE SUPREME COURTS ORDER ON RESERVATION IN PROMOTION TO ALL GROUP VIZ A B C & D EMPLOYEES. I WISH GOOD SENSE PREVAILS ON DOPT AND REQUEST DISABILITY COMMISSIONER TO HIGHLIGHT THE ORDER OF HON’BLE SUPREME COURT.
Draft dopt is not given on A.B groups promotion reservation for person with disabilities as per supreme court directions. Same dopt2005 is repeating, which was squashed by supreme court in 2016. And even supreme court pressurised to include in 2016 pwd bill passed by parliament both houses and alsi president signed gazzete was released by mentioning promotion reservation for person with disabilities in clause34. In this draft dopt was included 3% changed 4% and d,e extra 2 type of person with disabilities, remaining all same as supreme Court squashed dopt2005. Please stop this injustification, include the main point of all groups promotion reservation for person with disabilities.i. e A,B,C,D groups not only C &D groups.
