After the demand raised by National Council JCM Staff Side, now another opportunity has been given to Central Staffs to Re-exercise option for pay fixation under Rule 10 of CCS (RP) Rules 2016

OFFICE MEMORANDUM

Subject:- Date of next increment under Rule 10 of Central Civil Services (Revised Pay) Rules, 2016 – Clarification – regarding.

Date of Next Increment- Rule 10

The undersigned is directed to invite attention to this Department’s O.M. of even No. dated 28.11.2019 on the subject noted above. In Para ‘7’ of the said O.M. dated 28.11.2019, the employees who have been regularly promoted or granted financial up-gradation on or after 01.01.2016 and desire to exercise/re-exercise option for pay fixation under FR 22(I)(a)(1), were given an opportunity to exercise or re-exercise of their option for pay fixation within one month of the date of issue of the said O.M. dated 28.11.2019.

2.Thereafter, another opportunity to exercise/re-exercise the option for pay fixation, as allowed under O.M. dated 28.11.2019, was provided for a period of 3 months vide O.M. of even No. dated 15.04.2021.

3.However, a number of proposals are still being received from various Ministries/Departments for allowing another opportunity to exercise/re-exercise the option for fixation of pay as allowed under O.M. dated 28.11.2019.

4.Therefore, the Competent Authority in partial modification of the conditions enumerated in para ‘7’ of the said Q.M. dated 28.11.2019, has further approved for allowing another opportunity to Government employees to exercise/re-exercise option for pay fixation as allowed under O.M. dated 28.11.2019 within a period of three months from the date of issue of this Office Memorandum. No further request for extension of date or relaxation of condition in exercising of option will be entertained under any circumstances. Ministries/Departments are advised to give wide publicity of this O.M.

5. All other conditions of O.M. dated 28.11.2019 remain unchanged.

6.In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India”.

Clarification on another opportunity to Re-exercise option for Pay Fixation under Rule 10

Whether after promotion on 1st July and fixation of pay with two increments the date of next increment will be 1st January or 1st July ?

The Next Increment will be on 1st January as per the provision of Rule 10 of CCS (Revised Pay) Rules, 2016

Accrual of next increment in case of regular promotion/ financial up gradation of an employee on any date other than the date of annual increment and option for pay fixation is exercised under FR 22(1)(a)(1).

In the above case he may be allowed the 1st increment in promotional grade on 1st January/ 1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1st July/1st January (i.e., the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.07.2018. The next increment, thereafter, shall however, accrue only after completion of one year

DNI on 1st January 2023 and Promotion Pay Fixation done on 1st January 2023 then what will be the date of next increment in this case ?

The date of next increment for the above case is 1st July 2023
Therefore, if any Govt servant whose DNI was on 1st January, had their Promotion pay fixation done on 1st January 2023 , it should be ensured that the Next Increment after Promotion is granted on 1st July 2022.
